Writing for\nThis Is Money this month Grace Gausden reported: \u201cUnfortunately, the company\nwent into administration – but the owner subsequently setting up a similar\nbusiness under a different trading name, Tailored Franchises Ltd. When trying\nto get a refund after he realised the business was no longer trading, Dominic,\n31, was advised that nothing could be done, leaving him wondering how consumers\ncould be given so little rights.\u201d<\/p>\n\n\n\n

This is Money\nreported that because Dominic had paid by debit card, rather than on credit\ncard, he has been left with asking his bank for help. The bank\u2019s policy was to\nrepay money in some circumstances if the request was made within 120 days of\nthe transaction. Because the company kept stalling and not answering his calls\nfour months quickly passed and so the bank declared the money was lost.<\/p>\n\n\n\n

The Chartered\nTrading Standards Institute issued this statement: \u201cWe feel very sorry for this\nconsumer and I am afraid that when a business becomes insolvent there is little\nthat the consumer can do to reclaim what they have paid over. <\/p>\n\n\n\n

\u201cCustomers\nshould always try and pay for any goods costing more than \u00a3100 by a credit card\nif they have one. No matter how much of the purchase price is paid using the\ncredit card, the credit card company are equally liable, under Section 75 of\nthe Consumer Credit Act 1974, for any breach of contract.<\/p>\n\n\n\n

\u201cPayments\nusing a debit card are also protected, through the banks chargeback rules, so\nit would be worth the consumer contacting their bank to ask them to look into\nthis transaction, particularly because payment was taken some time earlier and\nthe order was not fulfilled. This is not a statutory right, so would be a\nmatter for negotiation with the bank.\u201d<\/p>\n\n\n\n

A Suit That\nFits, run by Daniel Warwick went bust in 2018 owing \u00a32m to its customers and\nsuppliers.<\/p>\n\n\n\n
